All users of the TreasureUnlimited.com website (User, You, Your, Advertiser, Viewer, Member) agree to be bound by these Terms of Use (this "Agreement"), whether You are an Advertiser or any other person viewing the site, and whether or not you are an individual, a corporation or some other form of entity. If You wish to become an Advertiser, and make use of any TreasureUnlimited.com Advertising service (the "Service") read the Agreement and indicate your acceptance by following the instructions in the Registration process.

This Agreement sets out the legally binding terms of Your use of The Website services and may be modified by Us from time to time, such modifications to be effective upon posting on the Website. It shall be the responsibility of each person using our services to check the current Agreement.

General. TreasureUnlimited.com is a service where Advertisers can list information on our site including, but not limited to, details of their item or service offered, together with a link to their own site, or some other contact details. An advertiser lists their advertisement by creating an account, uploading the information and if required an image. Then completing the text and or links they would like to appear within the Advertisement. A basic listing is free, however, a fee is charged by Us to Advertisers for some premium services. Viewing of all advertisements by all site users is free. A list of current fees for Advertisers may be viewed in the members area.

Term. This agreement shall remain in full force and effect while You use the Website and/or are an Advertiser. Once an advertisement is placed, an advertiser may make alterations to it for the following 48 hours. After that time, no further changes may be made to the advertisement. At the end of the specified time for display of the Advertisement, the Ad will be removed from display. We may terminate your Advertisement at any time if, in our sole opinion, we feel the advertisement does not meet any of our requirements for posting advertisements on this site (see below). We will attempt to email notification of termination to You at the email address You provide during Registration, however, failure to receive such email notice by You shall not preclude said termination. No refund of unused Advertising fees will be made for termination in any event.

Eligibility. All Persons, Corporations or similar Entities are eligible to use TreasureUnlimited.com. Use is void where prohibited. By Your use of the Website, You represent and warrant that You have the right, authority and capacity to enter into this Agreement, and to abide by all the Terms of this Agreement. Members must be at least 18 years of age.

Use. Unauthorized use of the site, which includes but is not limited to any activity considered illegal in any jurisdiction, the collection of email addresses and sending of unsolicited email is prohibited. Appropriate legal action will be taken against offenders.

Content posted on the site. You agree that We may review and delete any content You provide in Your listing details, at the sole discretion of TreasureUnlimited.com. You agree not to post anything that may contain or may be viewed by any other person as illegal, offensive, threatening, harmful, is false or misleading or that may violate the rights of others, whether they be users of The Website or not. We do not allow the display of anything sexually explicit. Content may be posted in any language. You are solely responsible for content You send to TreasureUnlimited.com By posting content to any area of The Website, You automatically grant, and You represent and warrant that You have the right to grant to Us an irrevocable, perpetual, non-exclusive, fully paid, worldwide license to use, copy, perform, display and distribute such information and content and to prepare derivative works of, or incorporate into other works, such information and content, and to grant and authorize sublicenses of the forgoing. Users of the site should be aware that links included in advertisements may take the user to another site. We cannot and do not accept responsibility for any content of any other site visited as a result of Your use of The Website. We are not currently allowing the use of animated gifs or other similar images in member advertisements.

Proprietary Rights to content on TreasureUnlimited.com. TreasureUnlimited.com owns and retains all proprietary rights in the Website and the Service. The Website contains copyrighted material, trademarks and other proprietary information of TreasureUnlimited.com and it's licensors. Except for that information which is in the public domain, or for which You have been given written permission by Us, You may not copy, modify, publish, transmit, distribute, perform, display or sell any such proprietary information. If You believe Your work has been copied and posted on The Website in a way that constitutes copyright infringement, please provide Us with the following information: an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest, a description of the copyrighted work that you claim has been infringed, a description of where the material that you claim is infringing is located on the website, your address, telephone number and email address, a written statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, it's agent or the law, a statement by you, made under penalty of perjury that the above information in your notice is accurate and that you are the copyright owner, or authorized to act on the copyright owner's behalf. We will not be responsible for the conduct, whether Online or Offline, for any user of the Service. We assume no responsibility for any error, omission, interruption, deletion, defect, delay in operation or other failure, theft, loss or unauthorized access to any User's communications, or any computer or communications equipment of any user. We shall not be responsible under any circumstances for any loss or damage, including personal injury and death, resulting from anyone's use of the Website or of the Service, any content posted on the Website, transmitted to any user, or users of the Website, whether online or offline. The Website and Service are provided "AS-IS" and We expressly disclaim any warranty or fitness for a particular purpose or non-infringement. We cannot guarantee, and do not promise any specific results from use of the Website and/or the Service.

Disputes. Users are solely responsible for their interactions with other TreasureUnlimited.com Users. Should you have a complaint about a user of the site or the Service, please contact us as soon as possible with full details, however, we accept no obligation to resolve, or enter into any such disputes. If there is any dispute about or involving the Website and/or the Service, You agree that the dispute will be governed by the Laws of the State of California without regard to its conflict provisions. You agree to Personal jurisdiction by and venue in the state and federal courts of the State of California, Los Angeles division.

Indemnity. You agree to hold TreasureUnlimited.com, it's subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorney's fees, made by any third party due to or arising out of Your use of the Service in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of Your representations and warranties set forth above.

Limitation on Liability. Except in Jurisdictions where such provisions are restricted, in no event will We be liable to You or any third person for any direct, indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits arising from Your use of the Website and/or the Service, even if We have been advised of the possibility of such damages. Notwhithstanding anything contained herein to the contrary, TreasureUnlimited.com's liability to You for any cause whatsoever, and regardless of the form of the action, shall at all times be limited to the amount paid, if any, by You to Us.

Other. We may, at Our sole discretion, communicate via email to any Advertiser, a warning of any minor violation of the forgoing Agreement. The Member and/or User agrees to immediately comply with any request or directives in the warning.

This Agreement, accepted upon your use of the Website contains the entire agreement between You and TreasureUnlimited.com regarding the use of the Website and/or the Service. If any provisions of this Agreement are held invalid, the remainder of this Agreement shall continue in full force and effect.
